Income Tax Notices & Assessments
An Income Tax notice or assessment communication requires careful examination before a response is submitted. Different notices are issued by the Income Tax Department for different purposes, including return processing, information requests, scrutiny, defective returns, tax demands, rectification and reassessment.
Investax India provides end-to-end support for reviewing Income Tax notices, understanding the issues raised, preparing supporting information and submitting appropriate responses through the Income Tax e-Filing portal.
Our objective is to help taxpayers understand the communication, identify the applicable compliance requirement and respond within the prescribed time.
Important Update: Income-tax Act, 2025
The Income-tax Act, 2025 came into effect from 1 April 2026. However, the transition between the Income-tax Act, 1961 and the new Act is important when dealing with notices and assessments.
Proceedings relating to tax years beginning before 1 April 2026 continue under the Income-tax Act, 1961, including assessment, reassessment, rectification, penalty, revision and appeals, subject to the applicable provisions.
The Income-tax Act, 2025 applies to Tax Year 2026-27 and subsequent tax years.
Therefore, the relevant tax year and the nature of the proceeding should be identified before preparing a response to an Income Tax notice.
What Is an Income Tax Notice?
An Income Tax notice is an official communication issued by the Income Tax Department, Centralised Processing Centre, Assessing Officer or another authorised income-tax authority.
A notice may request information, propose an adjustment, require clarification, initiate scrutiny or reassessment proceedings, communicate a tax demand or require the taxpayer to take a specific compliance action.
The appropriate response depends on the section mentioned in the communication, the assessment year or tax year, the information requested and the facts of the taxpayer's case.

Notice u/s 139(9) – Defective Income Tax Return
A defective return notice may be issued when the Income Tax Department identifies a defect in the return that requires the taxpayer to provide a correction or response.
The taxpayer should carefully review the defect mentioned in the notice and take the required corrective action within the prescribed period.
If the defect is not corrected or the notice is not appropriately responded to, the return may be treated as invalid in accordance with the applicable provisions.
Notice / Adjustment u/s 143(1)(a)
A prima facie adjustment communication may be issued during processing of an Income Tax Return where the information reported in the return appears to differ from information available with the Income Tax Department.
The taxpayer is provided an opportunity to respond before the proposed adjustment is incorporated into the processing of the return.
Under the current e-Filing process, a response to a notice under Section 143(1)(a) is generally required within the time specified in the communication. The Income Tax Department's guidance states that the response is to be submitted within 30 days from the date of issue of the notice.
Scrutiny Assessment – Notice u/s 143(2)
A notice under Section 143(2) of the Income-tax Act, 1961 may be issued when the return is selected for scrutiny assessment.
Scrutiny proceedings may require the taxpayer to provide information, explanations and supporting documents concerning income, deductions, transactions, investments or other matters relevant to the return.
Investax India can assist with reviewing the notice, organising supporting documentation, preparing submissions and coordinating responses through the applicable e-Proceedings mechanism.
For AY 2026-27 and earlier assessment years, scrutiny proceedings continue under the Income-tax Act, 1961 even though the new Act is now in force.
Reassessment Proceedings
Reassessment proceedings may arise where the Income Tax Department has information suggesting that income chargeable to tax has escaped assessment.
Under the Income-tax Act, 1961, reassessment provisions include Sections 147 and 148 and related provisions.
Under the Income-tax Act, 2025, the corresponding reassessment framework is contained in Sections 279 to 286, with Section 280 corresponding to Section 148 of the old Act.
Under the new Act, the reassessment process generally involves information suggesting escaped income, an opportunity to respond through the prescribed procedure and a reasoned decision before the reassessment notice is issued, subject to specified exceptions.
The new reassessment provisions apply to Tax Year 2026-27 and subsequent tax years. Reassessment relating to tax years beginning before 1 April 2026 continues under the old Act.
Rectification of Income Tax Orders
Rectification may be available where an apparent mistake is identified in an order, intimation or other eligible income-tax proceeding.
Under the Income-tax Act, 1961, rectification is generally associated with Section 154.
Under the Income-tax Act, 2025, the corresponding rectification provision is Section 284.
Investax India can assist with reviewing the order, identifying apparent errors and preparing the appropriate rectification submission where applicable.
